WHAT IS COVERED BY OUR LIMITED WARRANTY?

We assure you that the furniture purchased from our company will be free from any defects in materials and craftsmanship from the date of purchase, for the duration of the specified warranty period.

WARRANTY PERIOD

Repairs or replacements do not extend the original warranty period noted above.

REPLACEMENT POLICY

We will replace any product, part, or component covered by this warranty that fails under normal use due to a defect in material or workmanship. This applies to items sold after the effective date of this warranty.

WHAT IS A WARRANTY?

A warranty is a promise from the manufacturer that a product will be free from defects in materials or craftsmanship. It serves to protect you from receiving a product with issues due to the manufacturing process. Most warranties are issued directly by the manufacturer, so all claims typically go through their service department. Defects may not be noticeable until after use but may still be covered, provided the product has been used in the manner intended.

IS IT A DEFECT OR DAMAGE?

Warranties cover defects related to manufacturing quality. They do not apply to issues that arise from use (wear and tear), mishandling, or accidents after purchase.

For example:

  • Using a chair or table as a ladder or step stool
  • Wedging or stacking too many chairs or tables together in storage, transport or at an event
  • Failure to care for your furnishings within the recommended maintenance standards
  • Routine degradation from extended use

Damage that occurs during shipping isn’t covered under the warranty but under separate criteria covered between Chivari and our shippers; these should be reported immediately (due to certain time limitations for making a claim) to client services for assistance.

HOW TO MAKE A WARRANTY CLAIM

Kindly contact Client Services at [email protected] promptly after noticing a defect that may give rise to a claim. The claim process will also include:

  • Providing a description of the defect(s)
  • Sending photos and/or videos of the defect(s)
  • Returning the item(s) for inspection
  • Allowing a reasonable time for replacement

If a defect is confirmed, you may receive repairs or a replacement at no additional cost.

INSTALLATION AND MAINTENANCE REQUIREMENTS

To be eligible for warranty coverage, the product, part, or component must have been installed and maintained in accordance with reasonable business practices (i.e. protected from sun, rain, inclement environments, overuse, etc.)

RECOMMENDED MAINTENACE AND CARE INSTRUCTIONS

  1. Storage:
    – When not in use, store in a cool, dry place away from direct sunlight.
    – If possible, keep it in a protective case or cover when not in use outdoors.
  2. Cleaning:
    – Clean regularly with a soft, damp cloth to remove dirt and debris.
    – For tougher stains, use a mild soap solution and rinse thoroughly.
    – Avoid abrasive cleaners or scrubbers that may scratch the surface.
  3. Sun Protection:
    – Limit prolonged exposure to direct sunlight to prevent color fading.
    – If used outdoors, place in shaded areas when possible.
  4. Temperature Considerations:
    – Avoid extreme temperature fluctuations, even for weather resistant products.
    – In very hot weather, provide shade or bring indoors during peak heat hours.
  5. Inspection:
    – Regularly inspect for any signs of wear, cracks, or damage.
    – If you notice any issues, address them promptly to prevent further deterioration.
  6. Handling:
    – Handle with care to avoid unnecessary impacts or drops.
    – Use both hands when moving or repositioning furnishings or accessories.
  7. Avoid Harsh Chemicals:
    – Do not use solvents, bleach, or other harsh chemicals for cleaning or maintenance.

Failure to meet these requirements may void the warranty.

WHO IS COVERED BY OUR LIMITED WARRANTY?

Our limited warranty only covers the original purchaser of our furniture. It does not cover any subsequent owner or other person to whom you sell or give our furniture.

WHAT DOES OUR LIMITED WARRANTY NOT COVER?

Our limited warranty for furniture and furnishings excludes coverage for the following:

  • Damage from misuse, abuse, accidents, alterations, improper storage, transportation, moving, reinstallation, installation of attachments or other modifications, including the loss of parts.
  • Tears, scratches, scuffs, or blemishes resulting from the above, or from the use of cleaning or conditioning products not specified in the care guide.
  • Normal wear and tear.
  • Rust or damage due to exposure to moisture or other natural conditions, including excessive changes in surface finishes.
  • Repairs not performed or authorized by us, including those using parts not provided by us.
  • Natural variations in upholstery appearance, wood grain, or figure.
  • Variations in color, grain, or texture of natural materials.
  • Exact color matching of textiles.
  • Damage resulting from failure to follow product use or maintenance instructions.

REMEDIES IF YOUR FURNITURE IS COVERED BY OUR LIMITED WARRANTY

If your furniture is defective and falls under our limited warranty, we will, at our sole discretion and at no cost to you, either supply replacement parts along with instructions for their use or replace the entire piece of furniture. We will cover all shipping and handling fees for sending replacement parts, returning the defective furniture, and delivering the repaired or replacement furniture, as needed.

OTHER LIMITATIONS TO OUR WARRANTY

The remedies outlined above are your only recourse and represent our full liability related to your purchase and use of our furniture. Our liability will never exceed the amount you paid for the defective furniture, and we are not responsible for any incidental, consequential, special, punitive, or exemplary damages.

THIS LIMITED WARRANTY IS THE ENTIRE, EXPRESS LIMITED WARRANTY FOR THE PRODUCT. ALL OTHER EXPRESS, STATUTORY, OR IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED WHERE ALLOWABLE BY LAW.

Some states do not allow for the exclusion or limitation of damages, so these limitations may not apply to you.

This warranty supersedes all prior and contemporaneous agreements, representations, or understandings, whether written or oral, relating to the product. This warranty may not be amended or altered except by written statement signed by an authorized representative of CHIVARI. CHIVARI will not be bound by any statements or representations that go beyond the terms of this warranty.

CHIVARI WILL NOT BE RESPONSIBLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR OTHER DAMAGES FOR LOST PROFITS, FOR LOSS USE OF THE PROPERTY, FOR DAMAGES TO THE PROPERTY OR ITS CONTENTS OR OCCUPANTS, OR FOR INCONVENIENCE, UNDER ANY THEORY OF RECOVERY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), UNDER THIS WARRANTY OR OTHERWISE.

CHIVARI reserves the right to revise or terminate this warranty at any time. Only products purchased from the revision date of this warranty through the revision date of any subsequent warranty (or any subsequent termination) will be covered by the warranty. This warranty shall be interpreted exclusively under the laws of the State of Florida.

CHIVARI may investigate any claim and test the defective product during the claim process. Your failure to keep the defective product and permit an investigation and testing will void this warranty. You must obtain a return authorization from CHIVARI before returning any product. Any product returned without authorization will be refused and all shipping costs will be your responsibility.

This warranty gives you specific legal rights. You may also have other rights, which vary from state to state. This warranty is valid only in the contiguous United States.
