Information security is important to Chivari. We have established appropriate physical, electronic and managerial safeguards to protect the information that we collect from or about our users. Chivari does, however, reserve the right at all times to disclose any information as Chivari deems necessary to satisfy any applicable law, regulation, legal process or governmental request.

You are responsible for all activities that occur under your account on our website, and for establishing security procedures for maintaining the security and confidentiality of passwords associated with your account. You may not share your account or password with anyone, and you agree to (1) notify Chivari immediately of any unauthorized access to or use of your password or any other breach of security; and (2) exit from your account at the end of each session on our website. You agree not to create an account using a false identity or information, or on behalf of someone other than yourself. Chivari is not liable for any loss or damage arising from User’s failure to comply with this section or any other provision of this Agreement.

1. Our Security Measures. We use appropriate technical and organizational safeguards designed to protect your information from unauthorized use, disclosure, and loss. We use encryption technology, including current industry-standard encryption protocols, to protect personal information in certain areas of our Sites during transmission across the Internet. We encourage you to take reasonable measures to protect your password and your computer to prevent unauthorized access to your account. Remember to sign out of your account and close your browser window if you are using a shared computer in a public place.

2. Data Retention. As part of the normal operation of this website, Chivari receives names, e-mail addresses or other personal or business information submitted by users.  In order to safeguard the website as well as you, the user (“User”), Chivari tracks the IP addresses of Users.  Some of this information may be disclosed to third parties or used by Chivari or third parties.  Chivari will not intentionally release this information to third parties unless we believe release is appropriate to comply with law; to enforce or apply this Agreement or other agreements; or to protect the rights, property, or safety of Chivari, our Users, or others.  Any information sent to Chivari through or as a result of this Website is provided without restriction or obligation on Chivari.  Chivari assumes no obligation to protect such information from disclosure.  Chivari may use this information and any ideas, concepts, know-how or techniques contained in the information that User sends us for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services incorporating such information.  However, Chivari has no intention to release such information to any third-party for commercial purposes and will undertake to protect such information from unintentional disclosure.

We will keep your information for as long as you have an account or as long as we need it to fulfill the purpose for which it was collected or disclosed to you at the time of collection. We may also keep some of your information as required to meet legal or regulatory requirements, resolve disputes, prevent fraud or abuse, enforce our terms of use, or for other legitimate business purposes.

We use “cookies” to keep track of your current shopping session to personalize your experience and so that you may retrieve your shopping cart at any time.

When we no longer have a need to keep your information, we will either delete it from our systems or anonymize it so that it no longer identifies you.

3. How do we Protect your Information? We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on Chivari servers.

4. Children’s Privacy. The Service is not directed to children, and we do not knowingly collect information from children under 18. If you are a parent or guardian and believe that we have information about your child, please contact us at [email protected].

5. Your Privacy Rights and Choices. To keep you informed about our latest offers, we may notify you of current promotions, specials and new additions to the Chivari website. You may unsubscribe from our newsletters by following the unsubscribe instructions in any email you receive from us.

When entering any of our contests or prize drawings, you provide your name, email address and mailing address. If you win, we will send the prize to the address entered and notify you by email. When you enter a contest or drawing you are also included in our newsletter list to receive notice of promotions, specials and new additions to the Sample Store site. You may unsubscribe from this news list by following the unsubscribe instructions in any email received.

6. Modify your account information. If you have a Chivari account, you can review and update certain account information by logging into your account. You may also contact us to request deletion of your account. If we delete your account, you will not be able to access it.

7. Opt-out of marketing communications. You can stop receiving direct marketing messages from us at any time by updating your preferences by clicking any “unsubscribe” link in any marketing message you receive from us. It may take up to 48 hours to process your request and update our systems. If you request that we stop sending you marketing messages, we will continue to send you administrative and service communications (such as order updates and other important or transactional information). If you use more than one name or email address when communicating with Chivari or using the Service, you may continue to receive communications from us to any name or email address not specified in your opt-out request.

8. Opt-out of text messages. You can stop receiving text messages at any time by texting “STOP”. After you send “STOP”, we may send you an additional text message to confirm that you have been “unsubscribed.” You will no longer receive text messages from that short code, but you may receive text messages if you are subscribed to other text lists. If at any time you have questions about the text messages, text “HELP”. After you send “HELP” we will respond with instructions on how to use our service as well as how to unsubscribe.  9. Online tracking opt-out. You can opt out of the sale of or processing of your personal information for targeted advertising purposes and limit interest-based advertising as described below.

10. Personal information requests. Depending on your location and the nature of your interactions with our Services, you may request the following in relation to your personal information:

Prior to responding to your requests, we may verify your identity by matching any requested identifying information you provide against the information we have about you. Depending on your jurisdiction, you may designate an authorized agent to make a request on your behalf. We will require the authorized agent to have a written authorization confirming that authority.

Chivari will never discriminate against you for exercising any of these rights, but you may lose access to certain functionality or the ability to interact with certain programs or offers due to changes in the personal information Chivari has access to after complying with your privacy requests.

11. Limits on your choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.
